1. Acceptance of Terms
By using Riivster (riivster.com and the Riivster collection tracker), you agree to these Terms of Service. If you are a parent or guardian creating or approving an account for a child, you agree to these terms on behalf of your child.
If you do not agree, please do not use the Service.
2. Eligibility and Age Requirements
- Riivster is designed for children ages 7 and older and their families.
- Children under 13 must have verifiable parental consent before their account becomes active. See our Privacy Policy for details on COPPA compliance.
- If we learn that a child under 13 has created an account without parental consent, we will deactivate the account and delete all data.
- Purchases from the Riivster shop require the buyer to be 18 years or older, or to have parental permission.
3. Accounts
- You do not need to create an account to browse the Riivster website or shop.
- An account is required to use the collection tracker, friends, and trading features.
- We use passwordless authentication (magic links sent to your email). You are responsible for maintaining access to your email account.
- You may only have one account per person.
- You agree to provide accurate information when creating your account. Display names do not need to be your real name.
4. Collection Tracker
- The collection tracker is a free tool that lets you catalog your Pokemon cards, view estimated values, and track your collection over time.
- Card values are estimates only. Values shown are based on publicly available market data and may not reflect the actual resale value of your specific card, which depends on condition, edition, and market demand at the time of sale.
- Riivster is not a financial advisor. Do not make purchasing or selling decisions based solely on values shown on Riivster.
- You own your cards. Adding a card to Riivster does not transfer any ownership to us.
5. Trading
- Trading on Riivster is a coordination tool for in-person card swaps between friends. Riivster does not facilitate digital trades, mail trades, or monetary transactions between users.
- Trade proposals are suggestions. Both parties must agree, and the physical exchange happens outside of Riivster.
- Trading features for children under 13 can be disabled by a parent at any time.
- Riivster is not responsible for the outcome of any in-person trade. Once cards are physically exchanged, that transaction is between the two individuals involved.
6. Shop and Purchases
- The Riivster shop sells repackaged Pokemon card bundles, mystery packs, and subscription boxes.
- All cards sold are genuine Pokemon cards. We do not sell counterfeit or proxy cards.
- Specific card contents of mystery packs and bundles are randomized. We do not guarantee specific cards in any pack.
- Subscription boxes can be canceled at any time from your account or by emailing [email protected].
- Refunds: Physical products can be returned within 30 days in original, unopened condition. Opened packs and subscription boxes cannot be returned due to the nature of randomized contents.
- Shipping times and costs are shown at checkout.
7. Selling Cards to Riivster
- You can submit your Pokemon card collection for a purchase estimate through the "Sell Your Cards" page.
- Estimates are non-binding until we receive and evaluate the physical cards.
- Once we confirm a purchase price and you accept, the sale is final.
- You represent that you legally own any cards you sell to us and have the right to sell them.
- For school card drives, all terms are covered in the separate School Partnership Agreement.
8. User Content
- "User Content" includes card photos, display names, and trade messages you submit to Riivster.
- You retain ownership of your User Content. By submitting it, you grant us a license to display it within the Service (for example, showing your card photos to your approved friends).
- You agree not to upload content that is harmful, offensive, illegal, or infringes on someone else's rights.
- We may remove content that violates these terms without notice.
9. Acceptable Use
You agree not to:
- Use Riivster for any illegal purpose
- Harass, bully, or threaten other users
- Create fake accounts or impersonate others
- Attempt to access other users' accounts or data
- Scrape, crawl, or use automated tools to extract data from Riivster
- Attempt to reverse-engineer or attack the Service
- Use Riivster to sell counterfeit Pokemon cards
- Circumvent parental controls or age verification
We reserve the right to suspend or terminate accounts that violate these rules.
10. Intellectual Property
- The Riivster name, logo, character design, website design, and original content are owned by Riivster.
- Pokemon, Pokemon card designs, and related trademarks are owned by The Pokemon Company International, Nintendo, and their licensors. Riivster is not affiliated with, endorsed by, or sponsored by any of these companies.
- Card images and pricing data are sourced from publicly available resources and used under fair use for the purpose of collection tracking.
11. Disclaimers
Riivster is provided "as is" and "as available." We do our best to keep the Service running smoothly, but we cannot guarantee:
- 100% uptime or availability
- Accuracy of card pricing data at all times
- That the Service will be free from errors or bugs
Card values shown are estimates based on market data and are provided for informational purposes only. Actual card values may differ based on condition, edition, and market fluctuations.
12. Limitation of Liability
To the maximum extent permitted by law, Riivster shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Service. This includes, but is not limited to:
- Losses from in-person card trades arranged through Riivster
- Decisions made based on card value estimates
- Loss of data due to technical issues
Our total liability for any claim related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.
13. Termination
- You can delete your account at any time by emailing [email protected] or using the parent dashboard.
- We may suspend or terminate accounts that violate these terms.
- Upon termination, we will delete your personal data in accordance with our Privacy Policy.
14. Changes to These Terms
We may update these terms from time to time. If we make material changes, we will notify you by email or by posting a notice on the website at least 30 days before the changes take effect. Continued use of Riivster after changes take effect means you accept the new terms.
15. Governing Law
These terms are governed by the laws of the Commonwealth of Virginia, United States. Any disputes will be resolved in the courts located in Fairfax County, Virginia.
